(Nasdaq: MYL) today announced it has entered into a definitive agreement with AstraZeneca PLC (AstraZeneca) to settle a lawsuit filed in the United States District Court for the Eastern District of Pennsylvania against Mylan alleging the drugmaker had a violation of the Anti-Drug Abuse Act (known as the AAD Act) of 2005, which prohibits the distribution of a drug that is misbranded without a warning. The lawsuit alleged Mylan violated the Act by failing to provide accurate prescription information and failed to adequately warn consumers of the dangers of taking the drug that caused such adverse reactions. Mylan also entered into a definitive agreement with the defendants to settle the suit and will have a 90-day exclusivity period from the date of filing, subject to certain conditions. Mylan will retain the exclusive right to market the drug at a price that is the lowest in the industry and for which it has demonstrated reasonable care, diligence and objectivity.
Under the terms of the settlement agreement, Mylan will be liable for any and all losses and expenses, including lost profits, including attorney fees, on claims for misbranded drugs, including those relating to the anti-emetic Crestor(R) (Crestor, generically known as rosuvastatin) and Zyprexa(R), which are FDA-approved medications for type 2 diabetes.
